How AI is used
From the books the trustee or lawyer designates, assemble a fact table for the investigation: acts, conduct, assets, liabilities, financial condition, and any fact that may show fraud, dishonesty, incompetence, misconduct, mismanagement or irregularity. Do not sign a report.
What the lawyer must review
Unless the court orders otherwise, the trustee shall investigate the acts, conduct, assets, liabilities and financial condition of the debtor, the operation of the business and the desirability of its continuance, and any other matter relevant to the case or to the formulation of a plan (11 U.S.C. § 1106(a)(3)). The trustee files a statement of that investigation, including facts on fraud, dishonesty, incompetence, misconduct, mismanagement or irregularity, and transmits a copy or summary to committees and any indenture trustee (§ 1106(a)(4)). The lawyer or trustee writes the statement that is filed. If that statement is presented to the bankruptcy court as a pleading, motion or other document, Rule 9011(b) is the certification of the legal and factual contentions. Rule 9011(a) excepts a list, schedule or statement from its signature requirement. The tool writes none of the filed text.
