- How AI is used
- List the facts in the books that bear on fraud, dishonesty, incompetence, misconduct, mismanagement, or irregularity, each with the page. Write no paragraph of the statement that will be filed or sent to creditors.
- What the lawyer must review
- 11 U.S.C. § 1106(a)(4) requires the trustee, as soon as practicable, to file a statement of the investigation under paragraph (3), including any fact ascertained on those subjects or on a cause of action available to the estate, and to transmit a copy or a summary as that paragraph requires. The lawyer writes and files it. Bankruptcy Rule 9011(b) certifies a document presented to the court. Rule 9011(a) excepts a list, schedule, or statement from the signature requirement. The lawyer still does not file tool-written prose. Formal Opinion 512 does not move the investigation to the tool.
