- How AI is used
- From the order-for-relief date, record whether notice of that order is on the file and whether at least 21 days' notice by mail of the meeting of creditors is on the file. Do not copy a taxpayer-identification number into the list.
- What the lawyer must review
- You decide who else must be told, and you do not treat a missing notice as a concluded defect. Federal Rule of Bankruptcy Procedure 2002(f)(1)(A) says the clerk, or another person as the court directs, must give the debtor, creditors, and indenture trustees notice by mail of the order for relief, except as subdivision (l) provides otherwise. Rule 2002(a)(1) says that, except as subdivisions (h), (i), (l), (p), and (q) provide otherwise, the clerk or the court's designee must give the debtor, the trustee, all creditors, and all indenture trustees at least 21 days' notice by mail of the meeting of creditors under section 341 or section 1104(b). Unless the court orders otherwise, that notice must include the debtor's employer-identification number, social-security number, and any other federal taxpayer-identification number. Rule 2002(n) says that in a voluntary case commenced by an individual debtor whose debts are primarily consumer debts, the clerk, or another person as the court directs, shall give the trustee and all creditors notice by mail of the order for relief not more than 20 days after the entry of that order. 11 U.S.C. § 341(a) is the meeting that notice concerns: within a reasonable time after the order for relief, the United States trustee shall convene and preside at a meeting of creditors. The opened rule does not require notice to a secured party by the end of the next business day, and it does not use a test of the whole or substantially the whole of the debtor's property.
