How AI is used
From the order-for-relief date and the chapter the lawyer marks, diary the chapter window and record whether a meeting has been called. Do not decide the outcome of the meeting.
What the lawyer must review
You decide whether section 341(e) means no meeting is called, and you do not decide what happens at the meeting. Federal Rule of Bankruptcy Procedure 2003(a)(1) says that, except as provided in section 341(e), the United States trustee must call a meeting of creditors to be held no fewer than 21 days and no more than 40 days after the order for relief in a chapter 7 or 11 case, no fewer than 21 and no more than 35 days in a chapter 12 case, and no fewer than 21 and no more than 50 days in a chapter 13 case. If the designated place is not regularly staffed by the United States trustee or an assistant who may preside, Rule 2003(a)(3) says the meeting may be held no more than 60 days after the order for relief. 11 U.S.C. § 341(a) says that within a reasonable time after the order for relief, the United States trustee shall convene and preside at a meeting of creditors. Section 341(c) says the court may not preside at, and may not attend, any meeting under that section. The rule says the meeting must include an examination of the debtor under oath, and that the presiding officer may administer oaths. That examination is not a document this list prepares. The committee note on Rule 2003 says section 341(e) can mean the court orders that a meeting not be convened where acceptances were solicited before commencement. Railroad and municipality cases were not opened. Do not apply these windows there without those sections.
