Find prior internal advice in the store the lawyer identifies
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Search only the store the lawyer identifies and return the passage, the date, and the author as the document states them. Do not say that the passage answers the new question.
- What the lawyer must review
- ABA Model Rule 1.1 requires the lawyer to bring the thoroughness and preparation reasonably necessary to decide whether earlier advice covers the new facts. ABA Formal Opinion 512 (29 July 2024) leaves the lawyer responsible for output of a generative tool, including a retrieval. A retrieved passage is a candidate. It is not a conclusion that the advice still applies, that privilege still holds, or that the facts are the same. The lawyer makes those judgments.
