List each point in the request for evidence or notice of intent to deny, the deadline printed on that notice, and the document in the file that relates to the point. Write no response.
What the lawyer must review
USCIS Policy Manual Volume 1, Part E, Chapter 6 says the maximum response time for a request for evidence is 12 weeks (84 days), and that regulations prohibit officers from granting additional time. The officer sets a time within that maximum that reflects the evidence requested. A notice of intent to deny must clearly state the deadline. If the requestor does not respond by the date, the request may be summarily denied as abandoned, denied on the record, or both. Where USCIS has authority and permission to disclose derogatory information, officers give notice of it in a request for evidence, a notice of intent to deny, or in certain cases a notice of intent to revoke, rescind, or terminate. Use the deadline on the notice. The lawyer writes the response.

  1. Open each relied-on authority independently. Confirm its existence, current status, proposition and any quotation or pinpoint reference.
  2. Calculate operative dates independently from the current rule and actual triggering event. Check exceptions and record the verified deadline.
  3. Verify the applicable jurisdiction and the version of each relevant law, rule or instrument in force at the material time.
  4. Confirm the output against the client’s instructions and the complete relevant source material, including omissions or contradictions.
  5. Resolve exceptions and record the responsible lawyer’s approval of the exact output and intended use.
