Build a status chronology for unlawful presence
Key facts

- YellowClose supervision
- How AI is used
- From the passport, I-94 and approval notices the lawyer identifies, list each period of stay, the authorized end date and any departure date, with the document cite. Do not count the days and do not say the person is inadmissible.
- What the lawyer must review
- 8 U.S.C. § 1182(a)(9)(B) treats a person as unlawfully present after the period of stay authorized by the government expires, or if the person is present without being admitted or paroled. More than 180 days but less than one year, followed by a voluntary departure before removal proceedings begin, and a later application for admission within three years, is one ground. One year or more, and a later application for admission within 10 years of departure or removal, is another. You decide whether either ground is met and whether an exception on the face of the section applies. The tool does not calculate the bar.
