Record the proposal closing time and the late-proposal facts
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Build the timetable from the date and time stated in the solicitation, and from any extension the contracting officer records. If the solicitation states no time, record that fact. Do not declare a proposal late and do not set a minimum number of days the solicitation must remain open.
- What the lawyer must review
- FAR 15.208(a) provides that offerors are responsible for submitting proposals, revisions, and modifications so that they reach the Government office designated in the solicitation by the time specified. If no time is specified, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date proposals are due. A proposal, modification, or revision received after the exact time is late and will not be considered unless it is received before award, the contracting officer determines that accepting it would not unduly delay the acquisition, and one of the further conditions in 15.208(b)(1) is met: an authorized electronic-commerce transmission received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day before the date specified; acceptable evidence that it was received at the designated installation and was under the Government's control before the time set; or it was the only proposal received. A late modification of an otherwise successful proposal that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted. The contracting officer must promptly notify an offeror whose proposal was late and must say whether it will be considered, unless award is imminent and the notice in 15.503(b) would suffice. The tool does not make that determination. Section 15.208 does not state a minimum number of days a solicitation must stay open.
