Assemble facts for a response to a government request for information

Key facts

How AI is used
List the facts the lawyer marks in the firm's own papers, each with its source page. Do not write the response that will be sent and do not add a capability the papers do not state.
What the lawyer must review
The response is a communication to the Government, and the lawyer writes it. ABA Model Rule 1.6(a) provides that a lawyer shall not reveal information relating to the representation of a client unless the client gives informed consent, the disclosure is impliedly authorized in order to carry out the representation, or the disclosure is permitted by paragraph (b). ABA Formal Opinion 512 (29 July 2024) applies that limit to information placed in a generative tool and leaves the lawyer responsible for what is sent. FAR 3.104-3 prohibits knowing disclosure of another person's contractor bid or proposal information, or of source selection information, before award, other than as provided by law. The tool writes none of the response.
