Prepare the procurement-integrity and organizational-conflict plan
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Build the plan and the conflict register from the roles and declarations the lawyer supplies. Do not decide that a conflict exists or that it has been mitigated.
- What the lawyer must review
- FAR 3.104-3 prohibits a person who has access to contractor bid or proposal information or source selection information from knowingly disclosing it before award, and prohibits knowingly obtaining that information. FAR 9.505 requires each contracting situation to be examined on its own facts. The rules in FAR 9.505-1 through 9.505-4 limit contracting so that organizational conflicts of interest are avoided, neutralized or mitigated. The contracting officer decides whether a significant potential conflict exists. The lawyer checks every declaration against the evaluation papers before the register is treated as complete.
