- From the contract passages the lawyer marks, list the passage, the page, and the reason the lawyer has written for treating it as confidential. Leave the reason blank where the lawyer has not written one. Do not decide that a passage is exempt from release.
- What the lawyer must review
- 5 U.S.C. 552(b)(4) lists trade secrets and commercial or financial information obtained from a person and privileged or confidential among the matters that are not subject to the disclosure otherwise required by the Freedom of Information Act. The subsection does not itself decide which contract passage meets that description. FAR 15.306(e) limits what government personnel involved in the acquisition may reveal during exchanges, including an offeror's technical solution and, without that offeror's permission, an offeror's price, subject to the exceptions in that paragraph. The schedule is a working paper. The lawyer decides what is claimed and what is said to the agency.
