Build the justification for other than full and open competition
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Assemble the justification from the facts and the authority the contracting officer names. Do not choose the authority and do not certify that the justification is complete.
- What the lawyer must review
- FAR 6.303-1 prohibits the contracting officer from commencing sole-source negotiations, commencing negotiations on an unsolicited proposal, or awarding any other contract without full and open competition unless the contracting officer justifies the action, certifies that the justification is accurate and complete, and obtains the approval FAR 6.304 requires. FAR 6.302-1 is the authority where the supplies or services are available from only one responsible source and no other type will satisfy the agency's requirements. Other authorities in FAR 6.302 are separate. The contracting officer certifies. Check the FAR version in force for that action.
