Record the costs position on a protection-order proceeding
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the application and any later withdrawal, set out who the opened section says bears the costs, and whether the section treats a withdrawal by itself as a reason to depart from that position. Do not write a costs submission or a costs order.
- What the lawyer must review
- The lawyer decides whether exceptional circumstances, or a vexatious, frivolous or bad-faith application, are arguable on this file, and writes anything that is filed.

Checklist
- Record s 154(1) own-costs as the starting point for an intervention-order proceeding and for variation, extension or revocation of a recognised DVO.
- Do not treat a withdrawal, by itself, as exceptional circumstances or as vexatious, frivolous or bad faith.
- If a costs order is being considered against an absent person, record the adjournment and the next-mention notice in s 154(5).
- Do not write the costs submission. Other states are blank until their sections are opened.
