- How AI is used
- From the current order, record the issue date, the expiry date printed on it, and whether the request is a renewal by the protected person or a change sought by the other party. Draft no motion.
- What the lawyer must review
- California Family Code section 6345 lets personal-conduct, stay-away and residence-exclusion orders issued after notice and a hearing last up to five years, and be renewed, on request, for five or more years or permanently, without a showing of further abuse. The renewal request may be brought within the three months before expiry. If the form states no expiry date, the order lasts three years from issuance. A request by someone other than the protected person to end or change the order early requires notice to the protected person by personal service or, if that person is in the Safe at Home program under Government Code section 6205 and following, by service on the Secretary of State. If the protected person cannot be notified, the court denies the motion without prejudice or continues the hearing. The courts self-help page has separate paths to change, end or renew. You write the request. Opinion 512.
