Count the life of a police emergency protective order
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Record the day the emergency protective order was issued and whether a court application has been filed. Do not decide which ending time applies.
- What the lawyer must review
- The lawyer decides the ending event and what the client must do before it. California Family Code section 6256 says an emergency protective order expires at the earlier of the close of judicial business on the fifth court day following the day of issuance, and the seventh calendar day following the day of issuance. Section 6250 is the issuance rule: a judicial officer may issue the ex parte order when a law-enforcement officer asserts the immediate-danger grounds the section lists. The order is not the long-term restraining order the Judicial Branch describes, which is decided later and can last up to five years.
