How AI is used
State whether the file contains a written objection to issuance of a passport for the minor, and whether it contains an order for joint legal custody or an order requiring both parents or the court to approve important decisions. Leave a blank for what the Department did. Write no objection and no request.
What the lawyer must review
Section 51.28(c)(1) says that at any time before issuance, the application may be disapproved and a passport may be denied upon receipt of a written objection from a parent or legal guardian, or from another party claiming authority to object, so long as the objecting party provides sufficient documentation of custodial rights or other authority. Subsection (c)(2) says an order providing for joint legal custody, or requiring the permission of both parents or the court for important decisions, will be interpreted as requiring the permission of both parents or the court as appropriate. Subsection (c)(3) treats a court of competent jurisdiction as a United States state or federal court or a foreign court located in the minor's home state or place of habitual residence. Subsection (c)(4) says the Department may require conflicts about custody orders to be settled by the appropriate court before a passport is issued. No page stating how to place a child on an alert list was opened, so you do not treat this record as that placement. You decide whether the objection or the order is sufficient. Family Code section 3020 does not create a passport stop.
