- What the lawyer must review
- Family Code § 3020 makes the child's health, safety and welfare the court's primary concern. Section 3044 creates a rebuttable presumption, after a finding that a party seeking custody perpetrated domestic violence within the previous five years against the other party, the child, the child's siblings, or a person described in § 3011(a)(2)(A), that sole or joint physical or legal custody to that party is detrimental to the best interest of the child. The presumption is rebutted only by a preponderance of the evidence. You check every line against the order. The sheet does not vary the order. Open § 3011 before you apply the cross-reference in § 3044.
