Record whether a child alert or a court order is blocking a passport

How AI is used
Record whether a child alert request or a court order is on the file, the date it was made, and whether the child already holds an Australian or foreign passport. Do not decide that the child cannot leave.
What the lawyer must review
The lawyer decides what, if anything, to ask for. The court fact sheet says a child alert request made at an Australian Passport Office is valid for 12 months, and a court-ordered child alert stays in force until the child turns 18 or as the court directs. A child alert does not stop the child departing on a valid Australian or foreign passport, and it does not cover a passport issued by another country. The fact sheet says that if a passport may be issued in another country, the embassy of that country should be contacted. If there is a threat of removal on a current passport, the court may order the child or the accompanying adult to deliver the passport to the court, which keeps it for the time in the order or until further order. The passport-office alert form was not opened.

Checklist

  1. Use 12 months for a passport-office request and the court's own end date for a court-ordered alert. Do not swap them.
  2. Do not tell the client a child alert stops departure. The fact sheet says it does not stop travel on a valid passport.
  3. A foreign passport is outside the alert. The fact sheet says to contact that country's embassy. Do not invent that country's rule.
