- Family Code § 4320(i) requires the court, in ordering spousal support, to consider all documented evidence of any history of domestic violence, as defined in § 6211, between the parties or against either party's child, including a nolo contendere plea, emotional distress, a history of violence against the supporting party, a protective order after a hearing under § 6340, and a court finding during the case. Section 4320(m) points to a criminal conviction of an abusive spouse when support is reduced or eliminated, and it cites §§ 4324.5 and 4325. Section 3044 is the custody presumption after a finding of domestic violence in the previous five years. Section 2550 is the equal division of the community estate. You decide which proceeding the document is for. Open § 6211 before you treat an event as domestic violence under § 4320.
