Prepare a premarital agreement from the settled terms

- How AI is used
- List the settled terms against Family Code § 1612's permitted subjects and mark any spousal-support waiver. Write no clause of the agreement.
- What the lawyer must review
- You write the agreement the parties will sign. California Family Code § 1612 lists what a premarital agreement may cover, including rights in property whenever acquired and disposition on separation, dissolution or death. A spousal-support provision is not enforceable against a party who was not represented by independent counsel when it was signed, or if it is unconscionable at enforcement. Section 1615: the agreement is not enforceable if the party against whom enforcement is sought did not execute it voluntarily, or if it was unconscionable when executed and the disclosure conditions in the section were met. Voluntariness under § 1615(c) includes independent counsel or a written waiver, and the advisement to seek counsel must be at least seven calendar days before signing. Opinion 512: the signed text is yours.
