Set each policy the lawyer supplies beside the standard the lawyer names and list the policy sentence that addresses it, or note that the policy has no sentence on that point. Do not rewrite the policy.
What the lawyer must review
34 C.F.R. § 668.16: to begin and continue to participate in any Title IV, HEA program, an institution must demonstrate to the Secretary that it is capable of adequately administering that program. Paragraph (a) requires administration in accordance with the statutory and regulatory provisions. Paragraph (b)(1) requires a capable individual responsible for administering all Title IV programs in which the institution participates. 20 U.S.C. § 1681(a): no person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance, except as that section provides. 20 U.S.C. § 1232g and 34 C.F.R. § 99.31 govern education records and the disclosures that may be made without prior consent. The lawyer decides which standard applies to which policy. Formal Opinion 512 and Rule 1.6: student records do not go into a public tool.
