From the asset notes the lawyer marks, list the asset, where it is, and the date of the proposed transfer. Do not write the motion or the factual showing.
What the lawyer must review
You write the motion and the factual showing. Rule 65(b) allows a temporary restraining order without notice only if specific facts in an affidavit or a verified complaint clearly show immediate and irreparable injury, loss, or damage before the adverse party can be heard, and the lawyer certifies in writing the efforts to give notice and why notice should not be required. An order issued without notice must state the date and hour, describe the injury and why it is irreparable, and state why it issued without notice. It expires at the time the court sets, not to exceed 14 days after entry, unless the court extends it for good cause for a like period or the adverse party consents. Rule 65(c) requires security in an amount the court considers proper, except that the United States, its officers, and its agencies are not required to give security. Rule 65(d) requires the order to state its reasons and its terms specifically and to describe the restrained acts in reasonable detail, not by referring to the complaint.
