Quote the contract default clause before deciding a notice is due
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Quote the clause that describes a default and any notice the clause requires. Do not say a statutory first-default notice is due.
- What the lawyer must review
- You decide whether any notice is required. No credit-code default-notice statute was opened. Section 1692g is about the validation disclosure and the 30-day dispute period in a consumer collection. It is not a first-default notice under a credit contract, and subsection (d) says a formal pleading is not an initial communication. Do not rename the contract clause as that disclosure. Rule 11(b)(3) applies if you later allege a default in a pleading. The facts of default are the facts in the file. You write any notice.
