Separate the judgment from the guarantee before execution
Key facts

- YellowClose supervision
- How AI is used
- List the judgment, if any, and any guarantee the file contains, each with its date and the parties it names. Do not say the guarantee can be enforced and do not add the two sums.
- What the lawyer must review
- You decide the path. Rule 69(a)(1) enforces a money judgment by a writ of execution unless the court directs otherwise, under the procedure of the state where the court is located, except as a federal statute governs. It does not say a guarantee is enforceable, and no guarantee statute was opened. If there is no judgment, Rule 69 is not the path. Rule 11(b)(3) is your certification if you later allege that a person owes the sum. 12 CFR § 1006.26(b) still forbids a debt collector to bring or threaten suit on a time-barred consumer debt. You decide that question. The tool does not compute a balance.
