- The demand is a letter the other side may later treat as a claim. The lawyer writes it from the schedule. If the project is federal public work, preserve the Miller Act notice and one-year suit periods in 40 U.S.C. § 3133 where a payment-bond claim is also in view. A defects claim on a private project is the contract plus the project state’s limitation and repose statutes, which must be opened for that state. Formal Opinion 512: do not send a generated statutory citation that has not been opened. Federal Rule of Evidence 702 is the standard if an expert will later testify to the cause or cost.
