- What the lawyer must review
- Section 5 of the FTC Act makes unfair or deceptive acts or practices unlawful, with the carve-outs in § 45(a)(2) for banks, savings and loan institutions described in section 57a(f)(3), Federal credit unions, common carriers and air carriers, among others. The Green Guides state the deception test the Commission uses for environmental claims: a claim is deceptive if it is likely to mislead consumers acting reasonably and is material, and it needs a reasonable basis before it is made. That guides section cites the Commission's deception and substantiation statements. Lanham Act § 43(a) reaches a false or misleading description of fact in commercial advertising that misrepresents nature, characteristics, qualities or geographic origin.
