- 15 U.S.C. § 2064(b) requires a manufacturer, distributor or retailer of a consumer product distributed in commerce to inform the Commission immediately of a substantial product hazard, unless it has actual knowledge that the Commission has been adequately informed. Motor vehicle equipment, as the statute cross-refers to 49 U.S.C. § 30102, is outside that duty. Cornell notes a later redesignation of that definition, so open the current subsection. Public notice under the section includes a clear and conspicuous notice on the firm's website and notice to a third-party website where the product was placed for sale. The Commission may also require other-language and broadcast announcements. Read the rest of subsection (c) for when. A refund under subsection (d) is the purchase price less a reasonable allowance for use if the product has been in the consumer's possession for a year or more at the earlier of public notice or actual notice.
