Prepare a response list to the other side's cost items
Key facts
- Human involvement
- RedLawyer-led
- How AI is used
- List each cost the other side claims, the amount, and whether it names a category in 28 U.S.C. § 1920. Do not concede an item, do not oppose an item, and do not write the response that is filed.
- What the lawyer must review
- Federal Rule of Civil Procedure 54(d)(1) provides that costs other than attorney's fees should be allowed to the prevailing party unless a federal statute, the rules, or a court order provides otherwise, and that the court may review the clerk's taxation on a motion served within 7 days after the clerk's action. 28 U.S.C. § 1920 is the list of items a judge or clerk may tax. An item that is not in that list is flagged for the lawyer. The lawyer decides whether it was necessarily obtained for use in the case and writes anything that is filed. Costs against the United States may be imposed only to the extent allowed by law. The schedule is not that filing.

Who does what
| Role | What they do |
|---|---|
| Assistance | Supporting preparation only. Consider narrowly defined preparation support after confirming the tool’s capability and permitted scope. The tool writes nothing into the document. Substantive advice, judgement and any restricted content remain with the responsible human. |
| Lawyer | Perform the substantive analysis and decisions. Independently check any permitted supporting work and approve the exact output for its intended use. |
Checklist
- Check the current court or regulator requirements, prescribed form and attachments for the intended document and filing.
- Verify the applicable jurisdiction and the version of each relevant law, rule or instrument in force at the material time.
- Confirm the output against the client’s instructions and the complete relevant source material, including omissions or contradictions.
- Resolve exceptions and record the responsible lawyer’s approval of the exact output and intended use.
