- Build a table of each action's court, the parties, and the claims and the class definition as the complaint states them. Write no motion and no note for the court.
- What the lawyer must review
- 28 U.S.C. § 1407: when civil actions involving one or more common questions of fact are pending in different districts, they may be transferred to any district for coordinated or consolidated pretrial proceedings. The judicial panel on multidistrict litigation transfers them if the transfer will be for the convenience of parties and witnesses and will promote the just and efficient conduct of the actions. Each action so transferred is remanded to the district it came from at or before the conclusion of the pretrial proceedings, unless it has already been terminated. The panel may separate a claim, cross-claim, counterclaim or third-party claim and remand it before the rest. This is not certification under Rule 23, and it is not a transfer for trial. You write any motion. You open the rest of § 1407 for how a transfer is started.
