List the statements Rule 23 requires in the notice, taken from the certification or settlement order, and mark any required statement the draft does not yet contain. Write no sentence of the notice that will be sent.
What the lawyer must review
For a class certified under Rule 23(b)(3), Rule 23(c)(2)(B) requires the best notice practicable, in plain language, stating the nature of the action, the class definition, the claims, that a member may appear through a lawyer, that the court will exclude any member who asks to be excluded, the time and manner for exclusion, and the binding effect of the judgment. Settlement notice is governed by Rule 23(e). You write the notice. Rule 11 applies when the notice, or a motion about it, is presented to the court.
