What the lawyer must review
42 U.S.C. § 675(5)(B) requires the status of each child to be reviewed no less frequently than once every six months by a court or by administrative review, in order to determine the safety of the child, the continuing necessity for and appropriateness of the placement, and the extent of compliance with the case plan. Section 675(5)(C) requires a permanency hearing no later than 12 months after the date the child is considered to have entered foster care, as determined under subparagraph (F), and not less frequently than every 12 months thereafter. Section 671(a)(15) provides that the child's health and safety are the paramount concern in determining reasonable efforts, and that reasonable efforts are made to preserve and reunify families, and to place the child timely in accordance with the permanency plan when continuing those reunification efforts is inconsistent with the plan. You read the rest of § 675(5)(B), (C) and (F) before you diarise a hearing. You write any request to change the plan.
