Track the tribunal-appointment steps after the notice of arbitration
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the arbitration clause, list the method it states for naming an arbitrator or umpire, the number of days it states, and the date each step falls due from the notice in the file. Do not name an arbitrator.
- What the lawyer must review
- 9 U.S.C. § 5: if the agreement provides a method of naming or appointing an arbitrator or umpire, that method shall be followed. If no method is provided, or a party fails to use the method, or there is a lapse in naming an arbitrator or in filling a vacancy, either party may apply and the court shall designate and appoint. Unless the agreement provides otherwise, the arbitration is by a single arbitrator. The lawyer decides whether there has been a lapse and writes any application. Formal Opinion 512: the diary is checked against the clause before a date is treated as missed.
