Prepare the employee record for an NLRB representation petition
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the documents the lawyer selects, list the proposed unit, the employees in that unit, and the support documents the lawyer has marked. Do not decide that a question of representation exists and do not write the petition.
- What the lawyer must review
- Representatives designated or selected for collective bargaining by the majority of the employees in a unit appropriate for that purpose are the exclusive representatives of all the employees in that unit for rates of pay, wages, hours of employment, and other conditions of employment (29 U.S.C. § 159(a)). When a petition is filed, the Board investigates and, if it has reasonable cause to believe that a question of representation affecting commerce exists, provides for an appropriate hearing. If the Board finds that question on the record of the hearing, it directs an election by secret ballot and certifies the results (§ 159(c)). You decide whether to file a petition, and you write it. No showing-of-interest percentage was in the opened text. Do not state one. This is not a majority-support determination.
