- Title VII makes it an unlawful employment practice to discriminate in compensation, terms, conditions or privileges of employment because of sex (42 U.S.C. § 2000e-2(a)(1)). The EEOC's 29 April 2024 explainer treats sex as including gender, sexual orientation, and pregnancy, childbirth or related medical conditions, and says those laws apply to employment practices. The charge-filing periods and the Commission's conciliation path are in 42 U.S.C. § 2000e-5(e) and (f). You write the charge. You choose the forum. A federal court filing is your Rule 11 certification. The EEOC's April 2024 harassment guidance page, when opened on 22 October 2026, stated that a court had vacated portions of that guidance nationwide and the guidance body did not load. Do not rely on the vacated text.
