Where this comes from
The official form is published by supremecourt.nt.gov.au; this page is a completion guide. Last checked on 2026-10-22.
When to use it
Use when an executor named in the last valid will, who is over 18, applies for probate in the Supreme Court of the Northern Territory. Letters of administration use other Form 88 documents on the forms page. AI does not draft the affidavits.
Used for these tasks
- Prepare the probate or letters-of-administration application pack
- Reconcile the documents for a probate or administration application
- Check the Tasmanian, ACT or NT Supreme Court index before assuming an AI practice direction
- Search the probate notices for competing applications before filing
- Prepare and check the probate notice before it is published
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
The grant pack is built on affidavits and oaths. AI may index documents already on the file and list the published forms; the lawyer writes every affidavit, oath and application.
AI may
- List the forms named on the court's page for this kind of grant, and mark which ones are already on the file
- Check that names and the date of death are consistent across documents the lawyer has already prepared
- Index the will, the death certificate and searches by date and source
AI must not
- Must not draft an affidavit, oath, inventory, renunciation or any other sworn or signed part of the grant
- Must not describe assets, liabilities or the will in words the lawyer has not settled
- Must not sign, file or publish a probate notice
The lawyer checks
- The current forms, and the right kit or practice direction, are used for this kind of grant
- Names match the will, and the notice period and searches are done before filing
- The current practice direction on generative AI, if any, has been checked before any tool is used
