When to use it
Use when a disclosure has been received and the organisation is setting the practical steps that keep the discloser, a witness or another person from detriment or a reprisal. A claim for compensation is a separate piece of work.
Used for these tasks
- Prepare the issues for a compensation claim for detriment
- Plan support and risk controls where detriment or a reprisal is alleged
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may tick the statutory kinds of detriment against a de-identified account of what has happened and list the support steps the lawyer has already chosen.
AI may
- Match each reported event to a paragraph of s 1317ADA or s 13(2), or mark it as outside both lists
- Record whether the person affected is the discloser, a witness or someone else
- List the support steps from the approved policy or the agency procedure, with the person responsible and the review date
AI must not
- Must not decide whether a reprisal or detriment has occurred
- Must not draft a compensation claim, a submission or a letter of demand
- Must not receive the discloser's name
The lawyer checks
- The regime is marked, so the corporations list and the public-sector list are not mixed
- Paragraph (c) is checked against the statute in use: s 1317ADA(c) includes duties; s 13(2)(c) is the employee's position
- Section 13(3) is considered before an administrative step is treated as a reprisal
- Any claim is taken to the compensation task and is not decided on this checklist
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
