When to use it
Use after an authorised officer has decided to allocate a disclosure, or not to allocate it, under s 43, and when the principal officer must give the discloser the notice in s 50. Download the current Ombudsman notification form for the notice that goes to the Ombudsman.
Used for these tasks
- Prepare the allocation and investigation worksheet for a public-sector disclosure
- Prepare the written reasons for not allocating or not investigating a public-sector disclosure
- Choose the Ombudsman notification for an allocation or investigation decision
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may list the statutory items for the notice the lawyer has chosen and leave a blank for each. The lawyer writes the notice and sends it.
AI may
- List the matters s 44(2), s 44A(3) or s 50 requires, matching the decision the lawyer has marked
- Mark the consent field for the discloser's name as blank until the lawyer records consent
- Note which Ombudsman form, if any, the tools page provides for the same decision
AI must not
- Must not write the reasons, the description of the conduct, or any sentence that will be sent
- Must not insert the discloser's name or contact details
- Must not send the notice to the discloser, the principal officer, the Ombudsman or the IGIS
The lawyer checks
- The decision is an allocation under s 43(3)(a), a decision not to allocate under s 43(3)(b), or a stop action direction, and the matching section is used
- The discloser's name and contact details are included only if they are known and the discloser consents
- A copy is given to the discloser under s 44(4) only if reasonably practicable
- The s 50 notice states the estimated length of the investigation where s 50(1)(a) applies
- The Ombudsman notification is the current form from the tools page, sent to the address on that page
