When to use it
Use for a landlord or agent when rent (or water usage or utility charges) has remained unpaid for at least 14 days under a NSW residential tenancy agreement. Reconcile the ledger first: an arrears figure that is wrong, or rent not yet 14 days overdue, makes the notice ineffective. For other breaches use the breach notice and the validity checklist in this library.
Used for these tasks
- Reconcile the rent ledger for an arrears notice or claim
- Check a landlord's termination notice for validity
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may reconcile the rent ledger against the agreement and bank records and fill the notice from the reconciled figures; the landlord's agent or lawyer checks the arrears, the 14-day tests and the dates before the notice is signed and served.
AI may
- Rebuild the rent ledger from the agreement's rent and due dates and the payments received, and show the date each period became overdue
- Calculate the date the rent had been unpaid for 14 days and the earliest termination date for the method of service
- Fill the premises, parties, arrears and dates into the notice from the reconciled schedule
AI must not
- Must not include in the arrears anything other than rent, water usage or utility charges payable under the agreement (for example repair costs or fees)
- Must not choose a termination date or service method without the lawyer or agent checking the service rules
- Must not sign or serve the notice, or tell the tenant they must leave regardless of payment
The lawyer checks
- Ledger reconciled to bank records, rent increases and any rent reductions or credits, and the arrears are rent, water or utility charges only
- Rent unpaid for at least 14 days before the notice is given, and the termination date at least 14 days after it is given (allowing for the service method)
- The notice states that the tenant need not vacate if they pay all arrears or enter and comply with a repayment plan, and any prescribed matters or approved form are used
- If the tenant pays or agrees a plan, the Tribunal or Sheriff is notified as s 89 requires
