Where this comes from
The official form is published by nntt.gov.au; this page is a completion guide. Last checked on 2026-10-17.
When to use it
Use when an Indigenous Land Use Agreement has been made and a party will apply to the Native Title Registrar to register it. Do not use to negotiate the ILUA itself, and always use the NNTT's current application forms and reg 9 certificate template.
How AI may be used
AI may cross-check the ILUA and application bundle against the registration requirements and extract key terms with clause references. Authorisation and certification evidence must be verified by the lawyer.
AI may
- Check the bundle against the NNTT's requirements table for the ILUA type and list missing items
- Extract parties, area description, surrender statements and the location of particular statements with clause references
- Draft the covering letter to the Registrar from the settled bundle
AI must not
- Must not assess whether the authorisation or identification of native title holders was adequate
- Must not process restricted cultural information included in authorisation records
- Must not prepare the reg 9 certificate content from assumptions about the consultation
The lawyer checks
- Correct ILUA type and registration pathway (certified or uncertified for area agreements)
- Authorisation under s 251A and any conditions are proved, or certification under s 203BE is obtained
- Statements required for registration effect are in the agreement and located correctly
- Reg 9 certificate from any registered native title body corporate party is complete and executed
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
