When to use it
Use when a client receives a Legal Aid NSW refusal or termination letter, or a grant with a condition they cannot meet, and the decision is one that can be appealed. Lodge within 21 days of receiving the decision, and consider an adjournment application if a court date is close.
Used for these tasks
- Triage a legal aid eligibility and means-test application
- Build a grant-of-aid merit assessment table
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may organise the refusal letter, the application and the new evidence into the appeal letter structure and calculate the 21-day date; the lawyer decides the grounds and writes the merit arguments.
AI may
- Extract the reference number, decision date, date of receipt and the stated reasons from the refusal letter
- Calculate the last day to lodge (21 days from receipt) for the lawyer to confirm
- Map each reason for refusal to the documents on file that respond to it
AI must not
- Must not state the client's income, assets or circumstances beyond what the documents show
- Must not write the argument that the matter has merit or meets a Legal Aid NSW guideline
- Must not treat a decision listed in s 56(2), such as who represents the client, as appealable
The lawyer checks
- The decision can be appealed and the appeal will be lodged within 21 days of receipt
- Each reason for refusal is answered, with supporting documents, and the reference number is on the letter
- Whether an adjournment application under s 57 is needed because of a court date
- The client has approved the appeal and the information about their means it contains
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
