When to use it
Use when a law practice deploys an AI chatbot or intake assistant on its website, portal or messaging channel. The terms support, but do not replace, proper scoping, testing and supervision of the tool: a disclaimer does not cure a tool that in fact gives tailored legal advice.
How AI may be used
AI can adapt these terms to the tool's actual scope, data flows and jurisdictions, but a lawyer must confirm that every statement matches how the tool really works and that nothing excludes non-excludable consumer rights.
AI may
- Tailor the scope, topics and jurisdiction sections to the tool's tested functions.
- Cross-check the terms with the collection notice and the vendor contract for data location and retention.
- Produce plain-language and accessible versions (for example Easy Read) for the lawyer to review.
AI must not
- Must not draft liability exclusions that purport to exclude Australian Consumer Law guarantees.
- Must not describe the tool as able to give legal advice, assess prospects or calculate deadlines unless it has been designed, tested and supervised to do so.
- Must not publish the terms.
The lawyer checks
- The terms match the tool's tested behaviour, escalation paths and data handling.
- The limitation clause preserves ACL rights and is not likely to be an unfair term.
- The supervising lawyer and complaints contact details are current.
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
