How AI may be used
AI can draft the notice from the tool's data-flow map and vendor terms, but a lawyer or privacy officer must confirm each statement against the actual configuration and contracts.
AI may
- Draft the notice from a data-flow diagram and the vendor's data processing terms.
- Check the draft against each APP 5.2 matter and list any gap.
- Produce a plain-language short version within a set word limit.
AI must not
- Must not state data locations, retention periods or sub-processors that have not been confirmed.
- Must not describe triage as "human" if any decision is made solely by the tool.
- Must not be used to collect real user data during drafting.
The lawyer checks
- Every APP 5.2 matter is covered or consciously omitted as not reasonable in the circumstances.
- The automated triage description matches the tool's actual logic and the privacy policy.
- Overseas recipients and countries are listed if practicable.
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
