When to use it
Give with the engagement letter for every new matter, and to existing clients when the firm first adopts AI tools or materially changes how it uses them. Keep it consistent with the AI-use clauses in the costs agreement and the approved AI tools register.
How AI may be used
AI can draft the notice from the firm's approved tools register and the professional guidance headings, limited to how the firm actually uses AI. A lawyer confirms each statement is true before it goes to clients.
AI may
- Draft the task list and data-handling paragraph from the approved AI tools register.
- Produce a shorter version for a website or client portal.
- Check the notice for consistency with the costs agreement AI clauses and the privacy policy.
AI must not
- Must not describe safeguards, data locations or contract terms that have not been verified against the vendor contracts.
- Must not promise that AI is never used if it is (for example, in embedded features of standard software).
- Must not record a client's consent on the client's behalf.
The lawyer checks
- Every tool and use listed matches the approved AI tools register.
- The costs paragraph matches the firm's billing policy and the client's costs agreement.
- The consent or restriction chosen is recorded on the matter and in the practice management system.
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
