When to use it
Use after AusCheck's final letter says the person is not eligible for an ASIC because of an adverse criminal record for a Tier 2 or Tier 3 security-relevant offence, or when reinstatement of a cancelled ASIC is being asked for on that page's terms.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
The tool lists the documents the AusCheck page asks for and the dates the lawyer supplies, and the lawyer decides what is lodged.
AI may
- Calculate 28 days from the date of AusCheck's final letter, using the date the lawyer enters, and flag the count.
- List court transcripts, the employer letter, references and other material the page describes, each marked held or not held.
- Record that there is no fee for the discretionary card itself, and that the applicant pays the cost of supporting documents.
AI must not
- Do not complete the online form. That form was not opened.
- Do not predict whether the Secretary will approve the card.
- Do not describe the Tier 2 or Tier 3 offence list. That page was not opened.
The lawyer checks
- Wait for the final ineligibility letter. The page says the 28 days run from the date of that letter.
- The page says the Secretary's powers are under the Aviation Transport Security Regulations 2005. Those regulations were not opened, so no regulation number is stated.
- A criminal-history submission is not a statutory declaration unless the lawyer decides one is required. This pack does not include one.
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
