When to use it
Use when finance is being taken over an airframe, helicopter or aircraft engine that meets the Cape Town thresholds, or when an IDERA is to be lodged with CASA. Confirm the asset meets the thresholds. A Personal Property Securities Register registration, if one is needed, is a separate step and is not described here.
Used for these tasks
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may compare the aircraft's seat count, payload and engine thrust with the thresholds on the department's page. The lawyer decides whether the Convention applies and what is registered, and a person lodges.
AI may
- Enter seat capacity, payload and thrust from the specification into the threshold table
- List whether an IDERA is in the finance documents and whether CASA's IDERA page has been read
- Keep a Personal Property Securities Register question on the checklist without answering it
AI must not
- Must not state that an international interest has priority
- Must not treat this checklist as a Personal Property Securities Register lodgement
- Must not lodge an IDERA or an international registration
The lawyer checks
- The asset meets a threshold on the department's page, using figures from the specification
- The Convention's application to this debtor, creditor and transaction is decided by the lawyer
- The IDERA, if any, matches CASA's current process
- Any Personal Property Securities Register registration is done from the Personal Property Securities Act and the current AFSA guidance, not from this page
