When to use it
Use after an award in an arbitration to which the Model Law applies, to record the correction, interpretation, additional-award and set-aside times. Enforcement of a foreign award under Part II is a different precedent.
Used for these tasks
- Diarise the correction, interpretation and set-aside time limits after an award
- Review an award for enforcement or set-aside points
Each task page says how far AI may help with the task and what the lawyer must review.
How AI may be used
AI may calculate the diary dates from the date the award was received and from any article 33 request on the file, and the lawyer decides whether to request a correction or to apply to set the award aside.
AI may
- Enter the date of the award and the date each party received it, from the file
- Count 30 days, 60 days and three months from those dates and show the working
- List any article 33 request already made, and the date it was disposed of
AI must not
- Must not decide that a ground for set-aside is made out
- Must not draft the request to the tribunal or the application to the court
- Must not use this diary for a foreign award that is being enforced only under Part II
The lawyer checks
- The award is one to which articles 33 and 34 apply, and Part II has not displaced Chapter VIII under section 20
- The receipt date is proved, not assumed from the date of the award
- Any agreed longer or shorter article 33 period is in the agreement or the parties' later agreement
- The court is one specified for article 34 by section 18(3)
