When to use it
Use to start an arbitration under the ACICA Arbitration Rules, or adapt it for an arbitration under the UNCITRAL Rules or an ad hoc domestic arbitration. Do not send it until any negotiation or mediation steps in the dispute resolution clause have been completed or excused.
How AI may be used
AI may produce a first draft from the arbitration clause, the facts brief and the chosen rules' required contents, but the lawyer confirms the clause, conditions precedent, commencement date and relief.
AI may
- Draft the notice from the clause, facts brief and the rules' list of required contents
- Check the draft against each required element and list anything missing
- Prepare the annexure index and the transmission checklist
AI must not
- Must not decide whether conditions precedent have been satisfied or waived
- Must not calculate limitation dates or decide when the arbitration commences
- Must not put the counterparty's confidential documents into a tool that does not keep them confidential
The lawyer checks
- The arbitration clause relied on is the operative one and is copied accurately
- Pre-arbitration steps are complete, excused or properly addressed
- The commencement date under the rules and the statute is worked out against limitation
- The notice, fee and copy to the respondent are sent as the rules require
