- How AI is used
- From the file, list whether the will is signed, who signed it, how many people signed as witnesses during the testator's lifetime, and any words already in the file about what the testator intended when signing. Quote the page. Write no petition and no outline of anyone's testimony.
- What the lawyer must review
- You write the petition. Section 6110(a) requires a will to be in writing and to satisfy that section. Section 6110(c)(1) requires at least two witnesses, present at the same time, who sign during the testator's lifetime after witnessing the signing or the testator's acknowledgment. Section 6110(c)(2) treats the will as compliant if the proponent establishes by clear and convincing evidence that, when the testator signed it, the testator intended the will to constitute the testator's will. That paragraph is not a reason to skip witnesses. Section 6100.5 still states when an individual is not mentally competent to make a will. A conservator's signature needs an order under § 2580, which was not opened.
