Sort will instructions by topic for the drafter
Key facts
- Human involvement
- RedLawyer-led
- How AI is used
- Sort the instructions the lawyer took into topics: who takes, what property, who is personal representative, and who is excluded. Quote the instruction note and the page. Write no clause.
- What the lawyer must review
- You write every clause. Probate Code § 6110 requires a will, except as that part provides, to be in writing, signed by the testator, or in the testator's name by another person in the testator's presence and by the testator's direction, or by a conservator under a § 2580 order, and witnessed by at least two persons present at the same time who witness the signing or the acknowledgment and understand that the instrument is the testator's will. Section 6110(c)(2) treats a will as compliant if the proponent proves by clear and convincing evidence that the testator intended the instrument to be the will. That paragraph is not a reason to skip witnesses. Section 6100.5 states when an individual is not mentally competent to make a will. You judge capacity. Opinion 512 does not move the drafting to the tool.
