List dated events from the file: the will date, who was present if the document says so, gifts to a drafter or a caregiver, and medical notes the file already contains. Quote the page. Make no finding on capacity or influence.
What the lawyer must review
Probate Code § 6100.5 states the two competence tests. Section 21380(a) presumes fraud or undue influence for a donative transfer to the listed people, including the drafter and a care custodian of a dependent adult during the service period or within 90 days before or after it. Section 21380(b) makes that presumption one affecting the burden of proof, rebutted by clear and convincing evidence, and § 21380(c) makes it conclusive for the drafter and for persons described in paragraphs (5), (6) and (7). You decide whether the chronology supports a contest. Section 6110 remains the execution rule for the will itself.
